Senate approved laws on issues of improving subsoil use and administrative justice

A meeting of the Chamber took place under the chairmanship of the Speaker of the Senate of the Parliament of the RK Maulen Ashimbayev, at which a number of laws initiated by deputies within the framework of implementing the instructions of the Head of State were considered.

At the Chamber meeting, senators considered in two readings the Law «On introducing amendments and additions to the Code of the Republic of Kazakhstan «On Subsoil and Subsoil Use» on issues of improving subsoil use in the sphere of hydrocarbons and uranium», in accordance with which the peculiarities of conducting geological study in poorly studied territories and a number of other important procedures are defined.

«The considered law was initiated by deputies in execution of the instructions of the Head of State on improving subsoil use. The norms of the law are aimed at the further development of geological exploration of hydrocarbons. For this purpose, measures are provided to stimulate investors to conduct research in such territories. In addition, amendments on uranium production in the interests of the country are provided. In general, we hope that the law will contribute to the sustainable development of leading industries – production of hydrocarbons and uranium», – noted Maulen Ashimbayev.

At the same time, the Law provides for measures to stimulate subsoil users to apply special methods for increasing oil recovery. To minimize speculative deals, a ban is introduced on the transfer of the subsoil use right in the sphere of hydrocarbons during the first three years of the contract validity. Also, the law provides for a number of amendments on the development of the uranium industry. Thus, in territories with uranium mineralizations or uranium deposits determined in the program for managing the state subsoil fund for the purposes of conducting uranium exploration operations, only the national company in the field of uranium can act as the applicant.

Senators also considered the Law «On introducing amendments and additions to certain legislative acts of the Republic of Kazakhstan on issues of administrative justice, rule-making and organization of legal assistance».

«The law is aimed at further improving legislation in the spheres of administrative justice, rule-making and organization of legal assistance. In this regard, the transfer of separate categories of public-legal disputes from the Civil Procedure Code and the Code on Administrative Offences to the Administrative Procedural-Processual Code is envisaged. The procedure for conducting administrative procedures has also been revised. A number of amendments are provided for scientific support of rule-making activity and provision of legal assistance to citizens. We believe the law will have a positive influence on expanding the sphere of administrative justice and increasing public trust in administrative procedures», – said the Chairman of the Chamber, commenting on the approved law.

Thus, amendments and additions are introduced into a number of legislative acts of the country, including the Code of the RK on Administrative Offences, the Civil Procedure, Administrative Procedural-Processual Codes, as well as other laws. To increase professional standards and guarantees of independence of advocates, ensure their procedural rights in accordance with the principles of the rule of law, a number of amendments are proposed to the Law «On Advocacy Activity and Legal Assistance»,. Thus, the Law clarifies the mechanism for deprivation of a license to engage in advocacy activity, eliminates redundancy of procedures and duplication of powers of justice bodies and bar associations. These amendments are proposed to maintain a balance between state control and the professional autonomy of the advocacy, unify the procedure for admission of advocates to state secrets with other participants in justice, as well as reduce the administrative burden on justice bodies.

In addition, senators voiced their deputy inquiries.

Nurtore Zhusip called on the Government to review some provisions of the program «With a diploma – to the village»,. The senator believes that non-fulfillment of obligations by program participants does not bring the declared benefit and only noticeably reduces budget funds.

Olga Bulavkina raised the question of ensuring effective control over the use of funds within the framework of the project «Auyl – El Besigi».

Galiaskar Sarybayev stated the necessity of legislative regulation of the activity of children's slot machines, which increasingly appear near places visited by children – schools, sections and clubs.

Zhanna Assanova focused attention on systemic gaps in the development of the domestic pharmaceutical industry and voiced ways to overcome them. Among them is the development of a National program for the release of substances with a list of molecules for localization, economic calculations and infrastructure requirements.

Gennady Shipovskikh expressed concern about the rapid growth of debt dependence among youth. The solution to the problem, in the opinion of the senator, can be the tightening of the procedure for issuing microcredits for young people and the introduction of the subject of financial literacy in schools.

Bibigul Zheksenbai proposed to introduce international quality standards for agricultural products, approve standards for feeds and consolidate maximum permissible levels of substances in state standards. The reason served the state of quality and safety of Kazakhstan products of animal origin.
