Under the chairmanship of the Speaker of the Senate of the Parliament of the RK, Maulen Ashimbayev, a meeting of the Chamber was held, at which senators considered a number of laws and voiced deputy inquiries as part of the implementation of the tasks of the Head of State.
During the Chamber's meeting, the deputies considered in two readings the Law «On amendments and additions to some legislative acts of the Republic of Kazakhstan on intellectual property». As was noted, the adoption of the Law will contribute to the creation of an effective system for the protection and defense of rights to the results of intellectual activity, conditions for the development of creative industries, creativity, and the stimulation of innovation.
«The considered law is aimed at improving the mechanisms for protecting intellectual property rights. To this end, a single digital platform has been introduced to ensure the transparency of the collective rights management system. In addition, legal norms have been provided for that clarify the exclusive rights of broadcasting organizations, as well as the introduction of a new mechanism for conducting an examination of a trademark application in an accelerated manner. Special attention is paid to the issue of ensuring access to information for people with visual impairments. We hope that the law will give an impetus to the work on protecting intellectual property rights and developing the creative industry», – noted Maulen Ashimbayev, commenting on the approved law.
Along with this, as was noted, the Law provides for norms concerning an increase in the period for filing an objection against the registration of a designation as a trademark for a period of up to 2 months, as well as the establishment of the possibility of refusing to issue a patent for an invention at the stage of formal examination. The Law imposes a number of obligations on organizations that manage property rights on a collective basis, including the entry into a single digital platform of information about the collected, distributed, and paid remuneration, the rights transferred to it for management, and other obligations.
At the same time, the senators considered the Law «On amendments and additions to some legislative acts of the Republic of Kazakhstan on culture, education, family, and state control» initiated by the deputies.
«The norms of the considered law are aimed at improving the legal regulation in a number of industries. In particular, the law contains a number of amendments designed to strengthen the requirements for adoption. The procedure for the state attestation of educational organizations for a comprehensive assessment of the quality and accessibility of education has also been improved. Measures are provided for the development and preservation of the library collection. In addition, new mechanisms of control and supervision have been introduced to ensure the sanitary and epidemiological well-being of the population. During the consideration of the law, the senators made a number of proposals to improve certain norms. In general, we hope that the law will contribute to the further development of the sphere of culture, education, and state control», – said the Speaker of the Senate and thanked the deputies.
According to the legislative norms, the use of phonograms during concert performances will be prohibited. Exceptions are television recordings and places not specifically adapted for holding spectacular cultural and mass events. Another novelty in the field of culture concerns the procedure for coordinating with the onomastic commission on the assignment and renaming of private educational organizations in honor of famous personalities.
A number of important amendments are also provided for in the sphere of education and state control. Now, the winners of international scientific project competitions, as well as the teachers who prepared them, will receive a one-time payment. Along with this, an exemption from mandatory work is being introduced for persons who studied at the expense of the state educational order, who are recipients of a state allowance and are raising children with disabilities or caring for persons with disabilities of the I group.
Following the discussion, the senators conceptually supported the Law «On amendments and additions to some legislative acts of the Republic of Kazakhstan on culture, education, family, and state control», but proposed to introduce a number of amendments to it. In particular, the proposed changes and additions concern the improvement of the education system, the protection of children's rights and the regulation of educational activities, the protection of consumer rights, and the development of the sphere of culture. Thus, amendments have been made to the Law «On the rights of the child in the Republic of Kazakhstan», according to which a person who is under dynamic observation in organizations providing medical care in the field of mental health cannot be a mentor and a participant in the national preventive mechanism. At the same time, districts and cities of regional significance are excluded from the list of local executive bodies that provide annual funding for the construction, reconstruction, and major repairs of state facilities of secondary education organizations. In accordance with the new paragraph of the law concerning the protection of consumer rights, information about a product (work, service) must necessarily contain an indication of the use of voice (vocal) phonograms, audiovisual recordings when providing entertainment services by performers of musical works in cases established by law. The terms of entry into force of some articles of the Law have also been revised. In this regard, taking into account the amendments proposed by the senators, it was decided to return this law to the Mazhilis.
In addition, the senators voiced their deputy inquiries.
Andrey Lukin expressed concern about the state of military discipline in the ranks of the Kazakhstani army and stated the need for a systematic updating of the legislation regulating the issues of law and order and the prevention of offenses among the personnel of the Armed Forces of the country.
Amangeldy Nugmanov called on the Government to take the construction of the Moiseyevsky water intake under personal control as a strategically and socially significant object for the region. According to the senator, the critically important project, developed as part of the implementation of the Head of State's instructions, is at risk of disruption without objective reasons.
Galiaskar Sarybayev focused the Prime Minister's attention on the engineering, technical, seismic, and environmental problems of the Kok-Tobe television tower in Almaty and the «Bolshoi Shagan» radio and television station in the Zhetysu region. Based on the identified risks, the senator voiced a number of proposals for resolving the situation.
Amangeldy Yesbai voiced the disappointing statistics of victims of pseudo-coaches and psychologists without professional qualifications. In order to avoid scaling the threat to the mental, social, and financial security of citizens, to protect the institution of the family and the rights of children, the senator proposed to toughen the responsibility of these specialists at the legislative level.
