The Senate passed Laws on further reform of the judicial system

Today, under the chairmanship of Senate Speaker Maulen Ashimbayev, a meeting of the Chamber was held, at which senators adopted laws aimed at further reforming the country's judicial system. It is important to note that all of them were initiated by members of Parliament.

Now the norm on attracting professionals specializing in narrow branches of law to the judicial system will be fixed by law. To do this, applicants will have to pass a separate competition, including passing a specialized qualification exam. These and other novelties are reflected in the Constitutional Law "On Amendments and additions to the Constitutional Law of the Republic of Kazakhstan "On the Judicial system and the Status of Judges of the Republic of Kazakhstan".

The powers of the Supreme Judicial Council to consider the appointment of candidates for vacant positions of judges are also being expanded. These norms were supported by senators and the Law "On Amendments and additions to some legislative acts of the Republic of Kazakhstan on the judicial system" was adopted in two readings at a meeting of the Chamber.

In addition, the senators also initiated a bill aimed at expanding the scope of application of conciliation procedures, as well as the implementation of approaches previously approved by the Head of State to simplify the civil process. The Law adopted today "On amendments and additions to some Legislative acts of the Republic of Kazakhstan on the improvement of civil procedural legislation and the development of institutions of out-of-court and pre-trial dispute settlement" is aimed at this. This Law clarifies the rights and obligations of mediators, promotes the development of online mediation. In addition, it is proposed to adapt the institution of an "exemplary judicial decision" from world practice and gives the right to the parties to choose extraterritorial jurisdiction. The essence of this principle is that a special IT program will automatically distribute the case not within one court, but among the courts of the whole country, taking into account their specialization and workload. At the same time, extraterritorial jurisdiction will be chosen only with the consent of both parties.

"The laws adopted today are designed to implement the initiatives of the Head of State to improve the judicial system. The laws initiated by the deputies of the Parliament provide for further modernization of the judicial system of the country. The system of selection of candidates for the position of judge and the mechanisms of competitive selection of judges are being improved. The new norms will also make it possible to widely use modern technologies in the judicial system, as well as expand the competence of the plenary session of the Supreme Court and the session of the Supreme Judicial Council," Maulen Ashimbayev said, commenting on the adopted Laws.

In conclusion, the Speaker of the Senate expressed the hope that the norms adopted by the Chamber will increase the efficiency of the judicial system and thanked his colleagues for initiating and developing these Laws.

Also during the meeting, Senator Nurlan Kylyshbayev voiced his deputy's request, in which he noted the need to reconsider raising the sufficiency threshold for withdrawing pension savings and making a decision on it exclusively by the Government.
