REGULATION

about the Council on Interaction

with Local Representative Bodies (Maslikhats)

under the Senate of the Parliament of the Republic of Kazakhstan

This Regulation defines the status, powers and organization of activities of the Council for Interaction with Local Representative Bodies (Maslikhats) under the Senate of the Parliament of the Republic of Kazakhstan.

1. General provisions

1.1 The Council for Interaction with Local Representative Bodies (Maslikhats) is an advisory body under the Senate of the Parliament of the Republic of Kazakhstan and is formed in order to develop proposals for improving legislation in the field of local governance and regional development.

1.2. The legal basis of the Council’s activity is the Constitution of the Republic of Kazakhstan, the Constitutional Law of the Republic of Kazakhstan “On the Parliament of the Republic of Kazakhstan and the status of its deputies”, laws and other regulatory legal acts of the Republic of Kazakhstan, as well as this Regulation.

1.3. The Council’s decisions are of advisory character.

2. Main tasks of the Council

The main tasks of the Council are:

2.1 Making proposals to improve the legislation of the Republic of Kazakhstan on the development of regions, local government and local self-government.

2.2. Development of recommendations, including in the preparation of Parliamentary hearings, on the main directions of development of local government and local self-government.

2.3. Assistance in the interaction of the Senate of the Parliament of the Republic of Kazakhstan with representative bodies (maslikhats), public, scientific and other organizations on lawmaking in the field of local government.

2.4. Analysis of possible results of implementation of decisions of state bodies directly related to the development of local public administration and development of appropriate recommendations.

2.5. Assistance in holding joint meetings, seminars, round tables and other events with the participation of deputies of local representative bodies (maslikhats).

2.6. Assistance in the implementation of measures to improve the skills and professional level of deputies of local representative bodies and employees of their offices.

3. Composition and structure of the Council

3.1. The Council is headed by a Chairman, determined by the Chairman of the Senate of the Parliament of the Republic of Kazakhstan.

3.2. The Deputy Chairman of the Council and the Secretary of the Council are elected by the members of the Council from its composition.

3.3. Chairman of the Council:

1) exercises general management of the Council’s activities;

2) makes a proposal on the composition of the Council;

3) makes proposals on the candidacies of the Deputy Chairman of the Council and the Secretary of the Council;

4) determines the date, place and time of the meetings of the Council;

5) chairs the meetings of the Council;

6) instructs the Deputy Chairman of the Council, the Secretary and the members of the Council;

7) represents the Council in relations with state bodies and public organizations;

8) resolves other questions of the organization of activity of the Council.

3.4. The composition of the Council is formed from among the deputies of the Parliament of the Republic of Kazakhstan.

The Council consists of the Chairman of the Association of Deputies of Maslikhats of Kazakhstan and the head of the Deputy Group “Onir”.

The inclusion of other individuals in the Council and exclusion out of it is the decision of the Board by the Chairman of the Council.

The composition of the Council is approved by the decision of the Council.

4. Organization of the Council’s activities

4.1. Council meetings are held as required.

4.2. A meeting of the Council shall be competent if more than half of the total number of members of the Council are present.

4.3. The work of the Council is carried out on the basis of semi-annual plans approved at its meetings.

4.4. Decisions of the Council are taken by open voting by a simple majority of those present.

4.5. Decisions of the Council are made out by the Protocol signed by the Chairman of the Council or the person substituting him/her. 

4.6. In the absence of the Chairman of the Council, his/her functions (on his/her behalf) are performed by the Deputy Chairman of the Council.

4.7. Members of the Council have the right to:

1) participate in all activities conducted by the Council;

2) make proposals on the work plan of the Council and the agenda of its meetings, as well as on the issues discussed within the competence of the Council;

3) participate in the preparation of draft decisions and materials for meetings of the Council and other events organized by the Council;

4) get acquainted with the materials relating to the work of the Council.

4.8. The Secretary of the Council:

1) ensures the development of the draft work plan of the Council;

2) formulates the draft agenda of its meetings;

3) organizes the preparation of materials for the meetings of the Council, as well as draft protocol decisions;

4) notifies members of the Council of the place, time and agenda of the next meeting of the Council, timely provides them with the necessary materials;

5) certifies by his/her signature extracts from the minutes of the meetings of the Council.

5. Ensuring the activities of the Council

5.1. Organizational and other support for the activities of the Council is carried out by the Apparatus of the Senate of the Parliament of the Republic of Kazakhstan.
